The initial decision to approve the signing of Bruno Caboclo by Partizan Mozzart Bet was immediately countered by Umana Reyer Venice. A few months forward, an appeal at the local level was accepted on Thursday. The dispute continues with the next step in the case to be delivered by the FIBA Appeals’ Panel.
Caboclo, 28, penned a contract with the Turkish Airlines EuroLeague outfit in November. He previously refused to report to the Italian club, despite having a contract according to the team.
Per the press release: “Umana Reyer Venezia acknowledges with satisfaction of the full acceptance, by the Collegio Permanente di Conciliazione e Arbitrato of Lega Pallacanestro Serie A, of the claim filed against Mr. Bruno Caboclo following the player’s refusal to respect his contractual commitments with Reyer.
The Collegio, in its final award, confirmed some very important principles, including the full validity and effectiveness of the agreement, which had been signed by the parties before the “federal form” was available, with the mutual commitment to reproduce the agreement in the form prescribed by the Lega Pallacanestro Serie A, proceeding to the consequent registration.
As further confirmation of the full acceptance of the claims put forward by Reyer, the Player was ordered to pay the full costs of the arbitration and the Club’s legal fees.
Therefore, the full correctness of Reyer’s actions was recognised and – above all – the persistence of the contractual bond that still obliges the player to formalise the commitments made and constitute the employment relationship in accordance with the Italian law and the collective bargaining agreement.
The dispute now continues before the FIBA Appeals’ Panel, appealed by the Club to obtain the annulment of the FIBA decision to grant the authorisation to transfer and sign for Partizan Belgrade on the mistaken assumption that there was no valid contract between Mr. Caboclo and Reyer.
Umana Reyer thus continues its action in the knowledge that it acted with the utmost fairness and maintains its determination to enforce, also in the international venues, the principle that contractual commitments must be respected and that a professional player cannot with impunity turn his back on clubs that have built the team and planned the season relying on agreements made.
The Club takes this opportunity to officially thank the Federazione Italiana Pallacanestro and the Lega Pallacanestro Serie A, in the persons of their respective Presidents Mr. Gianni Petrucci and Mr. Umberto Gandini, for the precious support publicly declared also in relation to the ongoing dispute before FIBA.”
